Terms of Service

1. Agreement

By downloading, accessing, or using Party Favor, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.

2. The service

Party Favor is an iOS party game app and companion website. Features may include a games library, pass-and-play modes, private online rooms, room codes, scores, and related social gameplay. We may add, change, or remove features at any time.

3. Eligibility

You must be at least 13 years old to use Party Favor. If you are under the age of majority where you live, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Accounts and rooms

• You are responsible for any activity under your account or the display name you use in a room.
• Keep room codes and invites limited to people you trust. Anyone with a code may be able to join that room.
• We may suspend or terminate access that appears abusive, fraudulent, or harmful to other players.

5. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Party Favor app for entertainment purposes on devices you own or control, in line with the App Store terms that apply to you.

You may not copy, modify, reverse engineer, rent, sell, or create derivative works from the services except as allowed by law.

6. Acceptable use

You agree not to:

• Harass, threaten, or abuse other players
• Submit illegal, hateful, pornographic, or otherwise objectionable content in rooms, punchlines, display names, or messages
• Impersonate others or misrepresent your identity
• Interfere with servers, rooms, or other players’ devices, including by cheating, scraping, or flooding
• Use the services for commercial spam or unauthorized marketing
• Violate applicable law

7. User content

You keep ownership of content you create in Party Favor (such as display names, answers, or punchlines). You grant us a worldwide, royalty-free license to host, store, transmit, and display that content as needed to operate the games and rooms you join.

You are responsible for your content. Other players in your room may see it. Do not share personal information you are not comfortable making visible to your group.

8. Intellectual property

Party Favor, including its name, logos, game designs, artwork, software, and branding, is owned by Party Favor or its licensors. These Terms do not transfer any ownership rights to you.

9. Third-party services

The services may rely on Apple, cloud hosting, authentication, or other third-party platforms. Their terms and privacy policies apply to those services. App Store purchases and refunds are handled under Apple’s rules.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free play, or that rooms will always sync perfectly across devices.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTY FAVOR AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

12. Indemnity

You agree to defend and indemnify Party Favor against claims, damages, and expenses arising from your content, your misuse of the services, or your violation of these Terms.

13. Termination

You may stop using Party Favor at any time. We may suspend or end access if you violate these Terms or if we discontinue the services. Sections that by nature should survive (including ownership, disclaimers, and limitations) will survive termination.

14. Changes

We may update these Terms by posting a revised version on this page. The effective date will change when we do. Continued use after an update means you accept the revised Terms.

15. Governing law

These Terms are governed by the laws of the United States and the State of California, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise.
